Terms & Conditions (T&C)

These Terms & Conditions (T&C) govern the use of the websites and all services and products provided by CustomPC Private Limited (A Roger N Reckon Company), ("We," "Us," or "the Company" or "CPC" or "Custom PC ). By using our Services, you agree to these T&C, along with our separately published Privacy Policy, Cancellation & Refund Policy, and Shipping & Delivery Policy.

1. General Terms and Acceptance

1.1. Agreement: These T&C govern the use of all digital properties owned or operated by CustomPC Private Limited, including the domains custompc.in, custompc.ltd, custompc.co.in, custompc.online, custompc.space, and rnr.org.in (collectively, the "Website"), and all services and products provided, including Custom PC Builds, DeepClean, Performance Test Pro (PTP), RMA & Repair, and the purchase of components/goods (collectively, "Service Packages," "Services," or "Products").
1.2. Acceptance: By accessing the Website, purchasing any Product, or booking any Service or Service Package, the Customer ("You") agrees to be bound by these T&C and all referenced policies.
1.3. Capacity: You represent that you are at least 18 years of age and can form legally binding contracts under the Indian Contract Act, 1872.

2. Service and Order Terms (Process)

2.1. Pricing, Website Changes, and Quotations:
- A. Website Prices: Prices and specifications listed on the Website are dynamic and subject to change at any time without prior notice by CustomPC Private Limited management. Placing an item in a cart does not lock or reserve the price.
- B. Quotation Validity: Formal written quotations generated by the Company for Custom PC Builds (BTO) remain fixed and valid for 24 hours from the time of issuance, subject to Section 2.1.C.
- C. Market Volatility & Inventory Right: The Company reserves the right to revoke or adjust a quotation prior to the receipt of the mandatory 50% deposit in the event of extreme component market price fluctuations, supplier price revisions, or sudden stock unavailability. Upon deposit payment, the quoted build price is fully locked.
- D. Pricing Errors: The Company reserves the right to cancel any quotation or order resulting from typographical errors, system glitches, or obvious pricing misstatements, with a full refund of any prepaid amounts.
2.2. Custom PC Builds (BTO) - GST Inclusive:
- A 50% non-refundable deposit is required to confirm all Build-to-Order (BTO) PC orders.
- NOTE: Custom PC pricing is inclusive of 18% Goods and Services Tax (GST), and this inclusion will be stated near the listed price tag.
- The full balance is due upon completion and before dispatch/collection.
- Estimated Timelines: All delivery/build times are estimates only. (For Cancellation terms, refer to the Cancellation & Refund Policy.)
2.3. Component-Only Orders (Standard Sale):
- Full prepayment is required at the time of placing the order. (For Cancellation terms, refer to the Cancellation & Refund Policy.)
2.4. Repair, Upgrade, and Other Services (DeepClean, PTP, RMA & Repair, Complete360) - GST Exclusive:
- Diagnostic/Service Fee: A mandatory Diagnostic or Service Fee is due upon booking/intake. This fee excludes 18% GST and is non-refundable upon service cancellation after device acceptance or service commencement (e.g., technician arrival).
- Data Loss: It is your sole responsibility to back up all data, software, and personal files before submission. CustomPC Private Limited and Roger N Reckon are not liable for any loss of data.
- Abandoned Devices: Devices uncollected or unpaid for within 30 days after notification of completion will be considered abandoned and may be disposed of to cover charges.

3. Specific Service Terms and Exclusions

3.1. General Service Exclusion (DeepClean, PTP, etc.): All prices quoted for standard Services and Service Packages (including DeepClean and PTP, operated in partnership with Roger N Reckon) are exclusive of the mandatory 18% Goods and Services Tax (GST), which will be added to the final invoice. Furthermore, these services strictly exclude the repair, replacement, or cost of faulty hardware components. These services focus on cleaning, diagnostics, and assembly/re-assembly only.
3.2. RMA & Repair Services (Chargeable Repair Estimates and GST):
- For devices submitted under the RMA & Repair Service, we will provide a separate, extra, and chargeable estimate for any necessary hardware repair or replacement.
- This estimate and the resulting repair cost are exclusive of 18% GST, which will be added to the final invoice.
- Non-warranty repairs performed in-house are subject to the specific labor warranty periods and exclusions detailed in Section 6.2.
3.3. Complete 360 Package: This comprehensive package integrates these component Service Packages: DeepClean, Performance Test Pro (PTP), and RMA & Repair.

4. Payment Gateway and Transactions

4.1. Payment Methods: We accept payments via the methods displayed on our Website, processed through authorized third-party Payment Gateway Service Providers, or via official, pre-agreed bank transfers to the Company's registered bank account.
4.2. Authorization: Payment is accepted only after successful authorization and funds are credited to our account.
4.3. Unauthorized Use & Payment Processor Liability: You must only use payment methods for which you are the authorized user. We utilize authorized third-party Payment Gateway Service Providers (PSP) for all transactions. CPC does not directly store sensitive payment data. You acknowledge and agree that the security and handling of all cardholder data rest solely with the third-party PSP. CPC is not liable for any unauthorized use of your payment instrument or any resulting damages, including data breaches occurring within the PSP’s systems.
4.4. Chargebacks and Reimbursement: You agree to first attempt to resolve any payment disputes with CPC directly by contacting our support team prior to initiating a chargeback. If you initiate a chargeback that is subsequently disputed by CPC and proven to be unwarranted, fraudulent, or a breach of these T&C, you agree to reimburse CPC for any and all fees levied by the payment processor or card network, including the chargeback fee and any associated administrative costs incurred to resolve the dispute.
4.5. Forbidden Payment Channels (Social Media/Chat): CustomPC Private Limited does not accept or solicit payments through social media platforms, including but not limited to WhatsApp, Instagram, or Facebook Messenger, or via any personal, non-official QR codes shared on these platforms. All valid payments must follow the protocol outlined in Sections 4.1 and 6.5. Any loss incurred by the Customer from payments made via these unauthorized chat or social media channels is the Customer’s sole responsibility.
4.6. Customer Verification of Beneficiary Name: For all payments, including those made through third-party payment gateways, bank transfers, or UPI, the beneficiary or merchant name displayed on the payment screen must explicitly be "CustomPC Private Limited". If the displayed name is an individual's name or an unrelated company name, the Customer must not proceed with the payment and should immediately contact CPC's official support channels to report the discrepancy.

5. Intellectual Property & Content Usage

5.1. Company & Partner Ownership: Except for third-party intellectual property specified in Section 5.4, all original content on the Website—including text, website design, graphics, custom icons, and original brand media—is the property of CustomPC Private Limited. Proprietary service frameworks, brand names, and trademarks including Roger N Reckon (RNR), DeepClean, Performance Test Pro (PTP), Complete360, and RMA & Repair are the exclusive intellectual property of Roger N Reckon, licensed for use across CPC digital properties.
5.2. Website Use Permission (Browsing & Shopping): You are permitted to access and browse our Website content for the purpose of shopping, learning about our services, and placing orders, whether you are an individual consumer or a commercial entity. This permission does not include the right to copy, reproduce, or use any part of the Website (including its text, designs, or graphics) for your own commercial business operations.
5.3. Prohibition on Copying: Reproduction, duplication, copying, selling, reselling, or exploitation of any portion of the Services, use of the Services, or access to the Services without express written permission from CustomPC Private Limited is strictly prohibited.
5.4. Third-Party Intellectual Property: All third-party trademarks, brand names, and logos displayed on the Website (including, but not limited to, Intel, AMD, NVIDIA, ASUS, MSI, Gigabyte, and other hardware manufacturers) are the property of their respective owners. The display of these marks does not constitute an endorsement, direct affiliation, or claim of ownership by CustomPC Private Limited or Roger N Reckon.

6. Warranty and Liability

6.1. Manufacturer Warranty: All new components are covered solely by the original manufacturer's warranty.
6.2. Limited Warranty on Labor and Workmanship:
- 6.2.1. Scope of Warranty: CustomPC Private Limited warrants only the quality and execution of the labor and services provided (including DeepClean, diagnostics, and repairs). This warranty guarantees that the work was performed in a technically competent manner and will be free from defects in workmanship for the applicable period specified in Section 6.2.2, commencing from the Completion Date.
- 6.2.2. Warranty Periods:
  - Standard Services (DeepClean, Performance Test Pro): 7 calendar days from the Completion Date.
  - In-House Component-Level Repairs (Hardware): 7 calendar days from the Completion Date. (This warranty applies only to the specific part or area of work addressed.)
- 6.2.3. Conditions for Claim (All must be met):
  
  1. The problem observed is the exact same issue that necessitated the original service.
  
  2. The recurrence is conclusively determined to be the direct result of a specific failure or error in the initial labor execution.
- 6.2.4. Exclusions (What is Not Covered): This Limited Service Warranty is strictly limited to labor and does not cover:
  - Environmental Factors: Performance degradation or damage caused by dust, debris, pet hair, smoke residue, or poor air quality.
  - Wear and Tear: Component failures due to normal operational lifespan or stress.
  - User Misuse: Issues resulting from accident, misuse, unauthorized modification, or physical damage post-completion.
  - New Problems: Any new or different component failure not part of the original service.
  - Customer Intervention: Any fault arising directly or indirectly from the Customer opening the computer chassis, disconnecting internal cabling, altering component layout, or installing non-standard software post-completion.
  - Parts: Physical parts and materials covered solely by manufacturer warranties (Section 6.1).
6.3. Immediate Voiding of Warranty: The service warranty is immediately voided if the product is mishandled, physically damaged, or opened/repaired by any party other than CustomPC Private Limited staff during the 7-day period. CPC reserves the right to refuse warranty claims upon confirmation of Customer Intervention.
6.4. External Security Risks (No Liability): CustomPC Private Limited is not liable for financial losses, data breaches, or damages resulting from interaction with external malicious third parties (e.g., phishing, malware, or fraudulent websites not owned and operated by CPC).
6.5. Security Best Practices:
- Official Domains Only: Verify you are interacting only with custompc.in, custompc.ltd, custompc.online, custompc.space, custompc.co.in or rnr.org.in, rogernreckon.com, rogernreckon.in.
- Secure Connection: Confirm the site displays https:// and the lock icon in your browser address bar.
- Payment Channels: Pay only through official website links or pre-agreed official bank transfers. Never transfer money via unsolicited chat requests or social media.
6.6. Limitation of Liability: IN NO EVENT SHALL CUSTOMPC PRIVATE LIMITED, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR TIME). TOTAL LIABILITY FOR ANY DIRECT CLAIM SHALL NOT EXCEED THE EXACT PURCHASE PRICE PAID FOR THE SPECIFIC SERVICE OR PRODUCT.
6.7. General Disclaimers: Services are provided on an "AS IS" and "AS AVAILABLE" basis. Computer diagnostic and repair services carry an inherent risk of data loss; backup is the sole responsibility of the customer.

7. Reservation of Rights & Modifications

7.1. Right to Modify: CustomPC Private Limited reserves the right to modify, suspend, or discontinue any Service, Product, or these T&C at any time without prior notice.
7.2. Right to Refuse Service: We reserve the right to refuse, suspend, or cancel any Service or order. Prepaid amounts will be refunded minus a proportionate deduction for labor/services already rendered (such as completed diagnostic visits).
7.3. Termination Due to Customer Conduct: CPC reserves the right to terminate service immediately if the Customer engages in abusive, threatening, or harassing behaviour toward staff.
7.4. Cancellation Due to Out-of-Stock/Unavailability:
- CustomPC Private Limited specifically reserves the right to cancel any order (BTO or Component-Only) if required components are out of stock, discontinued, or unavailable.
- Notification will be provided via email, WhatsApp, or phone.
- Full refunds (including the 50% deposit for BTO builds) will be processed for cancellations initiated by CPC due to stock unavailability.

8. Governing Law and Dispute Resolution (Mandatory Arbitration)

8.1. Governing Law: These T&C shall be governed by and construed in accordance with the laws of India.
8.2. Mandatory Binding Arbitration:
- Requirement: Any dispute arising out of or relating to these T&C shall first be settled by Mandatory Binding Arbitration under the Arbitration and Conciliation Act, 1996.
- Venue & Seat: Delhi, India.
- Language: English.
- Finality: The arbitral award shall be final and binding on both parties.
8.3. Exclusive Jurisdiction: Subject to Section 8.2, courts in Delhi, India shall have exclusive jurisdiction over interim relief or enforcement matters.
